Terms of Service

By creating an account or using Foviq, you agree to these terms. If you do not agree, do not use the service. If you are using Foviq on behalf of an organisation, you confirm you are authorised to bind that organisation.

Your use of Foviq is also governed by our Privacy Policy, which explains what data we collect and how it is handled.

Foviq is a general wellness and fitness product. It is not a medical device. It does not diagnose, treat, cure, prevent or monitor any disease or medical condition. It is not contraception and must never be relied on to prevent or achieve pregnancy. It is not a substitute for professional medical, dietetic, psychological, or clinical advice.

Cycle phase estimates are statistical predictions based on the data you enter. They are frequently wrong for irregular cycles, and they are estimates rather than measurements even for regular ones. Training and nutrition suggestions are general wellness guidance, not a prescription.

Always seek the advice of a qualified health professional with any questions about a medical condition. Never disregard or delay professional medical advice because of something Foviq showed you. If you think you may have a medical emergency, contact emergency services immediately.

You must be at least 16 years old to use Foviq. By using it, you confirm that you are, and that the information you give us about yourself is accurate.

Foviq is not designed for use during pregnancy or the immediate postpartum period, and some cycle profiles are deliberately excluded from plan generation for safety reasons rather than being served a plan we cannot stand behind.

You are responsible for exercising judgement about your own body. Before starting any new exercise or nutrition programme, and particularly if you are pregnant, postpartum, recovering from injury or surgery, managing a chronic condition or an eating disorder, or taking medication that affects exercise tolerance, consult a qualified professional.

• Stop exercising immediately if you feel chest pain, severe shortness of breath, dizziness, faintness, or pain that is sharp rather than muscular.
• Tell us about allergies accurately. Our allergen filtering can only exclude what you have declared, and you should still check ingredients yourself before eating anything.
• Adjust or skip anything that does not feel right for you on a given day. A generated plan is a suggestion, not an instruction.
• Do not use Foviq as a tool to pursue disordered eating or excessive restriction. If you are struggling, please seek support.

You use Foviq at your own risk, and you accept responsibility for injuries or health outcomes arising from activities you choose to undertake.

You are responsible for keeping your login credentials secure and for activity that occurs under your account. Tell us promptly if you believe your account has been accessed without your permission. Do not share your account with others or create an account for someone else without their knowledge.

You agree not to:

• Use Foviq for any unlawful purpose, or in a way that infringes anyone else's rights.
• Attempt to access accounts, data, or systems that are not yours.
• Probe, scan, overload, or otherwise interfere with the service or the infrastructure it runs on.
• Scrape, bulk-download, or systematically extract our exercise, recipe, or educational content.
• Reverse engineer, decompile, or attempt to derive the source of the service, except where that restriction is unenforceable by law.
• Use automated means to create accounts or submit requests at abnormal volume.
• Attempt to manipulate the AI features into producing harmful, unsafe, or medically inappropriate output.
• Resell, sublicense, or commercially redistribute the service or its content without our written permission.

We may suspend or terminate accounts that breach this section.

The data you enter remains yours. You grant Foviq a limited licence to store, process and display it for the purpose of operating the service for you — including sending relevant context to our AI model provider as described in the Privacy Policy. This licence exists only to run the product, ends when you delete your data, and does not permit us to sell it or use it for advertising.

Foviq's software, design, brand, and its exercise, recipe and educational libraries are owned by us or our licensors and are protected by intellectual property law. You get a personal, non-exclusive, non-transferable, revocable licence to use them within the service. Nutritional data is derived from public sources including the USDA FoodData Central database.

Foviq is currently in pre-launch development and paid plans are not yet available. When they launch, the following will apply, and we will give notice before charging anyone.

• Prices and what each plan includes will be shown before you subscribe.
• Payment is handled by a third-party hosted checkout provider. Foviq never receives or stores your card details.
• Subscriptions renew automatically for the same period until cancelled.
• You can cancel at any time; cancellation takes effect at the end of the current billing period and you keep access until then.
• Fees already paid are generally non-refundable except where required by law, though we will consider reasonable requests.
• We may change prices with reasonable advance notice. Changes do not affect the period you have already paid for.

We are actively developing Foviq. Features may be added, changed, or removed, and the service may be unavailable at times for maintenance or because of factors outside our control. We do not guarantee uninterrupted or error-free operation.

If AI generation is unavailable, Foviq is designed to fall back to producing a plan deterministically from its own libraries rather than failing outright. Those plans are marked so you can tell the difference.

To the fullest extent permitted by law, Foviq is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will meet your requirements, that cycle predictions will be accurate, that recommendations will produce any particular result, or that defects will be corrected.

To the fullest extent permitted by law, Foviq and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses arising from your use of or inability to use the service.

Our total aggregate liability for any claim arising out of or relating to these terms or the service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or fifty U.S. dollars.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

You agree to indemnify and hold harmless Foviq and its operators from claims, damages, losses and reasonable legal costs arising from your breach of these terms, your misuse of the service, or your violation of any law or third-party right.

You may stop using Foviq and request deletion of your account at any time, as described in the Privacy Policy. We may suspend or terminate your access if you breach these terms, if we are required to by law, or if we discontinue the service.

If we discontinue the service, we will give reasonable notice and a means to export your data. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnity — will survive.

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and Foviq agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute not otherwise resolved.

Before starting formal proceedings, please contact us so we can try to resolve the issue directly. Most problems are settled quickly this way.

We may update these terms. If a change is material, we will update the date at the top of this page and notify you in the app or by email before it takes effect. Continuing to use Foviq after that point means you accept the revised terms. If you do not accept them, you should stop using the service and may request deletion of your account.
